FOSR – General Terms and Conditions of Sale (GTCS)

2. Acceptance of the General Terms and Conditions of Sale (GTCS)

By placing an order on the FOSR website, you fully and unreservedly accept these GTCS.
These GTCS may be amended at any time; the applicable version to your order is the one in force on the date of its validation.

3. Products

The products offered for sale are those displayed on the website at the time of the order.
Each product is described in detail (description, features, photographs).
Colors and characteristics may vary slightly depending on screen settings or due to the handmade/artistic nature of the creations.

4. Prices

Prices are indicated in euros, all taxes included (VAT).
The total amount (products + possible shipping costs) is displayed before order validation.
FOSR reserves the right to modify its prices, but products will be invoiced at the rate in effect at the time of the order.

5. Orders

To place an order, you must follow the online process.
By clicking on “Confirm Order,” you enter into a binding sales contract with FOSR.
Any validated order implies an obligation of payment.

6. Payment

Payments can be made by credit card via Stripe, or by any other method offered at the time of order (Apple Pay, Google Pay, Klarna, etc. if applicable).
The order will only be confirmed once the payment has been validated.

7. Delivery

Products are shipped to the address provided at the time of order.

  • Shipping zones: France and international shipping available.

  • Delivery times: provided as an indication only; delays cannot justify cancellation of the order or compensation.

  • Customs and duties: for shipments outside the EU, local duties or taxes may apply and remain the customer’s responsibility.

  • Carrier responsibility: FOSR cannot be held liable in case of loss, delay, or damage attributable to the carrier.

8. Right of Withdrawal

In accordance with the French Consumer Code, you have 14 days from receipt of your order to exercise your right of withdrawal without justification.

Return shipping costs are borne by the customer, except in the case of a defective product.
Returns must be sent to: 29 Rue Charles Levy, 88240 BAINS LES BAINS, France.
It is recommended to keep proof of shipment.
Exceptions: custom-made or personalized works requested by the customer are not subject to the right of withdrawal (Article L221-28 of the French Consumer Code).

9. Legal Warranties

All products are covered by:

  • The legal warranty of conformity (Articles L217-4 et seq. of the French Consumer Code).

  • The warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

In case of a defective or non-compliant product, you may request an exchange or a refund.

10. Personal Data Protection

Your personal data is collected solely for order processing and customer support.
It is processed in accordance with the Privacy Policy available on the website.
In accordance with the GDPR, you have the right to access, rectify, and delete your data by writing to fosrshop@gmail.com.

11. Intellectual Property

The website www.fosr.fr and all its content (texts, images, graphics, logos) are protected by copyright.
The works offered for sale remain the exclusive intellectual property of the artist and may not be reproduced without prior authorization.

12. Liability

FOSR’s liability may only be engaged in the event of direct damage related to the order.
Under no circumstances can FOSR be held liable for indirect damages (loss of opportunity, data loss, financial prejudice, etc.).

13. Governing Law and Dispute Resolution

These GTCS are governed by French law.
In the event of a dispute, an amicable solution will be sought as a priority.
Failing that, jurisdiction is assigned to the courts within the jurisdiction of FOSR’s registered office.
